These general terms and conditions (T&C) govern the business relationship between Konvel (owner: Matt Barlow, hereinafter the “provider”) and its customers (hereinafter the “customer”). By accepting an individual offer you acknowledge these T&C.
§ 1 Scope
These T&C apply to all contracts between provider and customer for the supply of self-build kits for Konvel-branded garden offices, together with related optional services (e.g. introduction of local trades, snagging appointments).
These T&C are primarily addressed to consumers within the meaning of § 13 BGB (German Civil Code). Where different rules apply to entrepreneurs (§ 14 BGB), this is identified explicitly.
Conflicting general terms and conditions of the customer apply only if the provider has expressly agreed to them in writing.
§ 2 Subject matter and scope of supply
The subject of the contract is the supply of a self-build kit in the configuration chosen by the customer (model, cladding, glazing, options). The kit consists of EU-manufactured SIP wall and roof panels, structural frame, entry door, residential-grade glazing, external cladding and the associated connectors and fasteners.
Not included: foundation, electrical and data connections, interior fit-out, heating and any building permits. The build itself is expressly not part of the contract and is to be carried out by the customer.
The provider supplies an accompanying step-by-step video guide in German, which forms part of the delivery.
§ 3 Conclusion of contract
The presentation of models and configurations on konvel.de does not constitute a binding offer. By submitting an enquiry through the configurator you make a non-binding request for information.
Based on your enquiry, the provider will issue an individual written offer. The contract is concluded only when the customer accepts that offer in writing or in text form within the binding period stated in the offer (typically 30 days).
The contract language is German. The contract text is stored by the provider and made available to the customer on request.
§ 4 Prices
Prices shown in the configurator are non-binding indicative prices, including statutory VAT. The binding price is set out in the individual offer.
We deliver across Germany. The travel surcharge is itemised transparently in the individual offer.
Optional services (screw-pile foundation via partner, snagging appointment) are itemised separately.
§ 5 Payment terms
Unless otherwise agreed in the offer, the following applies: a 30% deposit on conclusion of the contract and the remaining 70% before delivery. Exact payment modalities and account details are set out in the offer.
In case of late payment the provider is entitled to charge default interest at the statutory rate (§ 288 BGB).
§ 6 Delivery and passing of risk
Delivery time is typically three to four weeks from receipt of the deposit. Binding delivery dates are set out in the offer or a separate order confirmation.
Delivery area: all of Germany. Travel and logistics are itemised in the individual offer.
For consumers, the risk of accidental loss and accidental deterioration passes to the customer upon handover of the kit (§ 446 BGB). For entrepreneurs, the risk passes upon handover to the carrier.
The customer ensures that the delivery vehicle can safely reach and unload at the installation site. Delays or additional costs due to inaccessible sites are borne by the customer.
§ 7 Self-build and customer duties
The build is carried out by the customer. The provider supports with a complete video guide in German and will introduce local trades on request.
The customer is responsible for: choice and preparation of the installation site, a suitable foundation, any building permits, electrical and data connections, and interior fit-out.
Note: in North Rhine-Westphalia buildings up to 75 m³ gross volume are permit-free (Konvel Solo and Studio). For Konvel Galerie and for other federal states different requirements apply, which the customer is responsible for verifying. The provider gives non-binding information on request.
§ 8 Reservation of title
Until full payment of the purchase price, the delivered kit remains the property of the provider.
§ 9 Statutory warranty rights
Statutory warranty rights apply. The limitation period for consumers is two years from handover (§ 438(1) No. 3 BGB). For entrepreneurs it is one year from handover.
In addition the provider offers a voluntary guarantee of five years on the construction and two years on the installed components. Details are set out in the individual offer.
Obvious transport damage must be reported to the provider without undue delay, ideally within seven days of delivery.
§ 10 Liability
The provider has unlimited liability for damage resulting from injury to life, body or health, and for damage caused by intentional or grossly negligent breach of duty by the provider, its legal representatives or vicarious agents.
For breach of essential contractual duties (cardinal duties), liability is limited to the typical, foreseeable damage. Beyond this, liability for slight negligence is excluded.
The provider accepts no liability for damage caused by improper assembly performed by the customer in the self-build, or by improper site preparation (e.g. foundation, connections).
§ 11 Right of withdrawal
Consumers generally have a statutory right of withdrawal for off-premises and distance contracts (§ 312g BGB).
There is no right of withdrawal for contracts for the supply of goods that are not pre-fabricated and for whose manufacture an individual selection or determination by the consumer is decisive (§ 312g(2) No. 1 BGB). As Konvel kits are manufactured according to your individual configuration (cladding, glazing, options), the right of withdrawal is regularly excluded.
Where a right of withdrawal applies in an individual case, the full withdrawal instructions including the model withdrawal form will be provided in text form no later than with the individual offer.
§ 12 Data protection

§ 13 Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR) at https://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body under the VSBG.
§ 14 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers habitually resident in the EU, mandatory consumer-protection provisions of the country of residence remain unaffected.
Place of performance and jurisdiction is the registered office of the provider, to the extent legally permissible.
Should individual provisions of these T&C be invalid or unenforceable, the validity of the remaining provisions remains unaffected. The statutory provisions apply in place of the invalid provision.
